Please read these terms carefully. They include an arbitration clause and class-action waiver, and explain that Trowelo is not a contractor, broker, lender, or referral service and does not guarantee any cost or result.

1. Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Trowelo, a brand of The Nelson M Group LLC ("Trowelo," "we," "us"). They govern your use of trowelo.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If you do not agree, do not use the Services.

2. What Trowelo is, and is not

Trowelo is an information service. We explain home improvement planning, project costs, permits, and how to choose a contractor in general terms and share general ideas for how homeowners can prepare for and manage a project.

• Using Trowelo is free and voluntary, and requesting information does not obligate you to buy anything.
• Any work on your home is performed by the professionals you choose and is governed by your own agreement with them, not by Trowelo.
• We do not guarantee any cost, price, savings, timeline, permit outcome, or result for any project.
• You are never charged by Trowelo, and we do not share your details with contractors, lenders, or other third parties for their marketing.

3. Eligibility

You must be at least 18 years old, located in the United States, and able to form a binding contract to use the Services. You may only submit information about yourself, or about another person who has authorized you to do so.

4. Your information and accuracy

You agree to give accurate and current information and to update it if it changes. You may only provide a mobile number that you own or are authorized to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

5. Communications and text-message consent

If you opt in, you agree that we may contact you by email and, if you check the applicable boxes, by automated text messages as described in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. Reply HELP for help.

6. Acceptable use

You agree not to: (a) submit false, misleading, or someone else's information; (b) use the Services for unlawful, fraudulent, or abusive purposes; (c) interfere with or disrupt the Services or attempt unauthorized access; (d) use bots or automated means to submit forms; (e) copy, scrape, or resell our content without permission; or (f) impersonate any person or entity. We may suspend or end your access if you do.

7. Third-party links

Contractors, manufacturers, retailers, government agencies, lenders, and other organizations mentioned on or reached through the Services are independent third parties. We do not endorse any contractor, lender, product, or provider and are not responsible for the conduct, content, or decisions of third parties. Your relationship with them is between you and them, and their terms and privacy policies apply.

8. Intellectual property

The Services, including the Trowelo name, logo, text, graphics, and design, are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial purposes. Photographs on the Site are used under their respective free-use licenses.

9. Safety and your projects

Home improvement work can be dangerous and may be regulated. Information on Trowelo is general and may not fit your home, your local building code, or your circumstances. Before starting any project, confirm requirements with your local building department, use licensed and insured professionals where required, follow manufacturer instructions and safety practices, and turn off power, water, or gas where appropriate. If you choose to do work yourself, you do so at your own risk. If you hire a professional, your agreement is with that professional, and Trowelo is not a party to it and is not responsible for their work, pricing, or conduct. Trowelo does not recommend, rank, vet, or refer contractors.

10. Disclaimers

The services and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered or delivered on time.

Trowelo is not a contractor, broker, lender, or referral service and makes no representation about the cost, quality, safety, or outcome of any project, product, or professional.

11. Limitation of liability

To the fullest extent permitted by law, trowelo and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any home improvement, hiring, purchasing, borrowing, or other decision you make or don't make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnification

You agree to indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your provision of a phone number or other information that you were not authorized to provide.

13. Disputes, governing law, and arbitration

Informal resolution first. Before filing a claim, please contact us at [email protected] and give us 30 days to try to resolve it.

Binding arbitration. Except for small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Trowelo or The Nelson M Group LLC arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in your county of residence or by video or phone, at your choice. The arbitrator may award the same individual relief as a court, and judgment may be entered in any court of competent jurisdiction.

Class-action waiver. To the extent permitted by law, you and Trowelo each agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative action.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with the subject "Arbitration Opt-Out" and your name and mobile number.

Governing law. These Terms are governed by the laws of the state in which The Nelson M Group LLC has its principal place of business, without regard to conflict-of-law rules, and the Federal Arbitration Act. Subject to the arbitration clause, the state and federal courts located in that state have exclusive jurisdiction.

14. Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We may suspend or terminate access at our discretion, including for violations of these Terms. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and disputes) will survive termination.

15. Changes

We may update these Terms. We will post the new version with a new "Last updated" date. If you continue to use the Services after the effective date, you accept the updated Terms. For material changes, we will provide notice as required by law.

16. General

These Terms, together with the Privacy Policy and SMS Terms, are the entire agreement between you and us on this subject. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, and we may assign them in connection with a merger or sale of the business.
